(1) Definitions. The following definitions apply to the My Safe Florida Condominium Pilot Program (MSFCP Program) and all rules and forms incorporated therein:
- (a) Condominium Association or Association – In addition to any entity responsible for the operation of common elements owned in undivided shares by unit owners, any entity which operates or maintains other real property in which unit owners have use rights, where membership in the entity is composed exclusively of unit owners or their elected or appointed representatives and is a required condition of unit ownership.
- (b) Contractor – A person or entity licensed by the Department of Business and Professional Regulation selected by a Condominium Association to complete a Mitigation Project.
- (c) Final Inspection – The concluding inspection performed by a Wind Certification Entity upon completion of a Mitigation Project. The Final Inspection is used to identify Improvements that are observed as successfully completed on the condominium property.
- (d) Final Inspection Report – The document prepared by a WCE that provides a summary of the WCE’s findings from the Final Inspection and identifies any improvements made to the condominium property. The Inspector will use Form OIR-B1-1802, Uniform Mitigation Verification Inspection Form, incorporated by reference in Rule 69O-170.0155, F.A.C., to perform Final Inspections on condominium buildings with three (3) or fewer stories. Inspectors will use the Building Type II and III Mitigation Inspection Form when performing Final Inspections on condominium buildings with four (4) or more stories. - (e) Grant Application – The information and documentation submitted to the MSFCP Program via the Program Portal to determine eligibility for a Mitigation Grant. A Condominium Association interested in applying for a Mitigation Grant shall complete and submit the Grant Application, Form DFS-O1-014, effective 10/25, incorporated herein by reference, and available at http://www.mysafecondo.casemanagement.tbtech.com and HYPERLINK "https://flrules.org/Gateway/reference.asp?No=Ref-18465"https://flrules.org/Gateway/reference.asp?No=Ref-18465.
- (f) Improvements – Features that make a condominium property more resistant to hurricane damage that are eligible for a MSFCP Program Mitigation Grant.
- (g) Initial Inspection – The preliminary Inspection performed by a WCE prior to any Mitigation Project. The Initial Inspection is used to determine which, if any, specific Improvements are recommended for the condominium property.
- (h) Initial Inspection Report – The document prepared by the WCE that provides a summary of the WCE’s findings from the Initial Inspection and includes the recommended improvement(s). The Inspector will use Form OIR-B1-1802, Uniform Mitigation Verification Inspection Form, incorporated by reference in Rule 69O-170.0155, F.A.C., to perform Initial Inspections on condominium buildings with three (3) or fewer stories. Inspectors will use the Building Type II and III Mitigation Inspection Form when performing Initial Inspections on condominium buildings with four (4) or more stories. - (i) Inspection Application – The information and documentation submitted to the MSFCP Program via the Program Portal to determine eligibility for an Initial Inspection. A Condominium Association interested in applying for an Initial Inspection through the MSFCP Program shall complete and submit the Inspection Application, Form DFS-O1-010, effective 03/25, incorporated herein by reference, and available at http://www.mysafecondo.casemanagement.tbtech.com and HYPERLINK "https://www.flrules.org/Gateway/reference.asp?No=Ref-17948"https://www.flrules.org/Gateway/reference.asp?No=Ref-17948.
- (j) Mitigation Grant – A grant that assists Condominium Associations to pay for their Mitigation Project.
- (k) Mitigation Project – The Improvements made to a condominium property based on the recommendations by the WCE in an MSFCP Program Initial Inspection Report.
- (l) Program Portal – The MSFCP Program’s internet portal located at the following website: http://www.mysafecondo.casemanagement.tbtech.com.
- (m) Quality Control Inspection – An additional Inspection that may be performed by a WCE to verify the accuracy of an Initial or Final Inspection.
- (n) Reimbursement Request – The information and documentation submitted to the MSFCP Program via the Program Portal to request a Final Inspection and the disbursement of Grant funds. A Condominium Association interested in submitting a Reimbursement Request through the MSFCP Program shall complete and submit the Request, Form DFS-O1-016, effective 03/25, incorporated herein by reference, and available at http://www.mysafecondo.casemanagement.tbtech.com and HYPERLINK "https://www.flrules.org/Gateway/reference.asp?No=Ref-17954"https://www.flrules.org/Gateway/reference.asp?No=Ref-17954.
- (o) Story – The portion of a building included between the upper surface of a floor and the upper surface of the floor or roof next above, containing a habitable, conditioned space intended for human occupancy. A Story includes above ground parking garages. A Story does not include attics, crawlspaces, mechanical mezzanines, basements, commercial spaces, or rooftop structures not designed for living purposes.
- (p) Wind Certification Entity (WCE) or Inspector – An entity or person that performs Initial, Final, and Quality Control Inspections for the MSFCP Program.
(2) Condominium Associations must upload the documentation required by the MSFCP Program through the Program Portal.
- (a) Before voting to participate in the MSFCP Program, a Condominium Association must provide unit owners the Disclosure Notice, Form DFS-O1-012, effective 10/25, incorporated herein by reference, and available at http://www.mysafecondo.casemanagement.tbtech.com, and HYPERLINK "https://flrules.org/Gateway/reference.asp?No=Ref-18464"https://flrules.org/Gateway/reference.asp?No=Ref-18464.
- (b) As part of the Grant Application, Condominium Associations must submit a notarized and completed Intended Contractors List and Commitment to Complete, Form DFS-O1-013, effective 03/25, incorporated herein by reference, and available at http://www.mysafecondo.casemanagement.tbtech.com, and HYPERLINK "https://www.flrules.org/Gateway/reference.asp?No=Ref-17951"https://www.flrules.org/Gateway/reference.asp?No=Ref-17951.
- (3) The MSFCP Program will utilize a geographic informational system (ArcGIS) to analyze the condominium’s latitudinal and longitudinal coordinates and its geographic relationship to the absolute boundaries of the fifteen (15) mile buffer of the state’s coastline to determine eligibility.

(5) The Condominium Association and Inspector shall coordinate to schedule any Inspections. If a Condominium Association is unable to schedule an Inspection with the WCE, the Condominium Association shall contact the MSFCP Program, at 1-877-891-0012, to request a new WCE. The Condominium Association’s MSFCP Program Application will be closed, and no further action will be taken by the MSFCP Program if the Condominium Association:
- (a) declines an Inspection;
- (b) refuses to allow the Inspector access to the condominium building;
- (c) fails to schedule the Inspection after the Inspector makes three (3) attempts to schedule; or
- (d) fails to appear for the Inspection.
- (6) A Condominium Association’s Grant Application will be denied if the actual construction of the Mitigation Project begins prior to Grant Application approval.
- (7) Improvements must be recommended in the Initial Inspection Report and identified in the Final Inspection Report to be eligible for a Mitigation Grant. The MSFCP Program will not provide Mitigation Grant funds for any construction not recommended in the Initial Inspection Report. The statements in the Initial Inspection Report and Final Inspection Report dictate MSFCP Program eligibility, regardless of other information or statements made outside the Initial Inspection Report or Final Inspection Report.
- (8) A Condominium Association shall not assign any Mitigation Grant funds under the MSFCP Program to any other person or entity. A Condominium Association that assigns, encumbers, or transfers, or any attempt thereof, an interest in a Mitigation Grant shall result in a denial of the Grant Application and the MSFCP Program will not pay the Mitigation Grant.
- (9) Mitigation Project costs include applicable Contractor overhead, indirect costs, profit, taxes, and permitting. Any other costs associated with construction at the condominium property are not authorized for Mitigation Grant funding. Any differences in costs between the Contractor’s invoice and the information submitted in a Reimbursement Request should be noted by the Condominium Association.
(10) To apply for a Mitigation Grant, Condominium Associations must submit documentation showing they will receive an insurance credit, discount, or other rate differential as a result of the recommended improvements. Acceptable documentation includes:
- (a) Correspondence from the insurance carrier or agent acknowledging that the recommended improvements will qualify the structure for a mitigation credit or discount;
- (b) An insurer’s mitigation credit schedule showing how recommended improvements affect premium rates for the structure; or
- (c) A copy of the carrier’s underwriting or mitigation guidelines specifying the credit, discount, or rate differential for recommended improvements for the structure.
