1. (1) Unless expressly exempted in Rule 40B-3.051, F.A.C., a permit must be obtained from the District prior to the construction, repair, modification, or abandonment of any well within the District.
2. (2) A permittee shall obtain a separate permit to abandon any failed attempt to construct a water well unless the drilling depth, casing depth, and location of the failed attempt are documented on the completion report of the completed well at the same permitted location.

3. (3) A general permit is hereby granted for the construction, repair, modification, or abandonment of a piezometer, monitor well, or remediation well installed for investigation or rehabilitation at sites regulated by the Department’s Division of Waste Management pursuant to Chapter 376, F.S., provided all of the following conditions are met:

   1. (a) The work is conducted by, or under the supervision of, a water well contractor;
   2. (b) The work complies with the construction and abandonment requirements of this Chapter;
   3. (c) The final water-bearing casing diameter is four inches or less;
   4. (d) The total borehole depth does not exceed 150 feet; and
   5. (e) The well is plugged by, or under the supervision of, a water well contractor upon completion of the site investigation or remediation.
