1. (1) The Division of Fruit and Vegetable Inspection may examine the plant yield records at its discretion and compare the results of its examination with the plant’s certifications of yield for the corresponding period, and, with such other data as may be necessary, verify the accuracy of the certification. Selection of plants for such discretionary records examination shall be based on the following criteria:

   1. (a) Recovery rates exceed or fall below typical recovery rates.
   2. (b) Plant reporting has been incomplete or not in a timely manner.
2. (2) Each plant which employs an independent auditor shall provide to the Division of Fruit and Vegetable Inspection a copy of any annual audit reports relating to plant yield. All individual plant information supplied or disclosed to the Department of Agriculture or to the Department of Citrus hereunder shall be held in strict confidence by those state employees to whom such information is entrusted or revealed.
