D.C. Mun. Regs. tit. 3, § 1303
1303.1 A Commissioner may resign prospectively, by submitting an irrevocable letter of prospective resignation to the Board of Elections.
1303.2 The letter of prospective resignation shall be sworn, shall state that it is irrevocable, and shall give the date that the resignation will become effective.
1303.3 The Commissioner shall also submit copies of the letter of prospective resignation to the following:
(a) The Council of the District of Columbia;
(b) The Mayor; and
(c) The Chairperson of the member's Advisory Neighborhood Commission.
1303.4 Upon receipt of an irrevocable letter of prospective resignation, the Board shall process the prospective vacancy in the same manner outlined for filling an existing vacancy.
1303.5 The resignation shall become effective not more than sixty (60) days following receipt of the letter by the Board of Elections.
