1801 NOTICE OF RIGHT TO A HEARING
1801.1 The Department shall inform each complainant of the following, in writing, at the time of the initial application and at the time of any action that affects the complainant's claim for a service:
- (a) The right to request a hearing;
- (b) The method by which a hearing may be obtained;
- (c) The right to be represented by legal counsel, an individual with special knowledge or training with respect to early intervention services, a relative, a friend, or other spokesperson, at the complainant's own expense; and
- (d) The right to a qualified language interpreter or an interpreter for the hearing impaired, if the complainant, representative of the complainant, or the complainant's witness is deaf or because of a hearing impairment cannot readily understand or communicate the English language, at the expense of the Department; or
- (e) The right to a reader if the complainant, representative of the complainant, or the complainant's witness is severely visually impaired, at the expense of the Department.
