3302.1 Based on the findings of the investigation specified in section 3300 and to control disease transmission, the Department may issue an order of restriction or exclusion to a suspected food employee or the licensee or dealer without prior warning, notice of a hearing, or a prior hearing if the order recites:

1. (a) The reasons for the restriction or exclusion that is ordered;
2. (b) The requirement that the food employee or the licensee or dealer shall provide evidence demonstrating that the reasons for the restriction or exclusion have been eliminated;
3. (c) That the suspected food employee or the licensee or dealer may request a hearing by submitting a timely request as provided in section 3700 of this Code; and
4. (d) The name and address of the Department representative to whom a request for a hearing may be made.
