D.C. Mun. Regs. tit. 20, § 3199
3199.1 When used in this chapter, the following words and phrases shall have the meaning ascribed:
Completely Dry Space - a space which will remain totally dry during flooding; the structure which is designed and constructed to prevent the passage of water and water vapor.
Construction - the construction, reconstruction, renovation, repair, extension, expansion, alteration, or relocation of a building structure.
DCRA/ERA/SRMD - Department of Consumer and Regulatory Affairs, Environmental Regulation Administration, Soil Resources Management Division.
Development - any manmade change to improve or unimproved real estate, including but not limited to buildings or other structures, streets, and other paving, utilities, filling, grading, excavation, mining, dredging, or drilling operations and the subdivision of land.
Essentially Dry Space - a space which will remain dry during floodings, except for the passage of some water vapor or minor seepage; the structure which is substantially impermeable.
FA (General Floodplain Area) - that portion of the identified floodplain for which no detailed flood profiles or elevations have been provided. They are identified in the Flood Insurance Study prepared by FEMA. Elevations are to be determined pursuant to §§3103.8 and 3103.9.
FEMA - Federal Emergency Management Agency.
FF (Flood-Fringe Area) - that area of the one-hundred (100) year identified floodplain not including the Floodway. The outermost boundary of this area shall be the one-hundred (100) year Flood Insurance Study prepared by the FEMA and as shown on the accompanying Flood Boundary and Floodway Maps.
Flood - a temporary inundation of normally dry land areas.
Flood-Fringe - that portion of the floodplain outside the floodway.
Floodplain - a relatively flat or low land area which is subject to partial or complete inundation from an adjoining or nearby stream, river or watercourse; or any area subject to the usual and rapid accumulation of surface waters from any source.
Floodproofing - any combination of structural and non-structural additions, changes, adjustments to structures which reduce or eliminate flood damage to real estate or improved real property, water and sanitary facilities, structures, and their contents.
Floodway - the designated area of a floodplain required to carry and discharge flood waters of a given magnitude. For the purpose of this chapter, the floodway shall be capable of accommodating a flood of the one-hundred (100) year magnitude.
FW (Floodway Area) - the area within the identified floodplain which is capable of carrying the waters of the one-hundred (100) year flood without increasing the water surface elevation of that flood more than one foot (1 ft.) at any point. The areas included in this area are specifically defined in the Floodway Data Table contained in the Flood Insurance Study prepared by the FEMA dated May 15, 1985, and shown on the accompanying Flood Boundary and Floodway Maps.
Identified Floodplain - the floodplain area specifically identified in this chapter as being
flooded by the one-hundred year (100) flood. Included are areas identified as Floodway (FW),
Flood - Fringe (FF), and General Floodplain (FP). The areas designated in the Federal Flood Insurance Study for the District of Columbia prepared by the Federal Emergency Management Agency dated May 15, 1985.
Manufactured Home - a structure, transportable in one (1) or more sections, which is built on a permanent chassis and is designed for use with or without a permanent foundation when connected to the required utilities. For flood plain management purposes the term "manufactured home" also includes park trailers, travel trailers, and other similar vehicles placed on a site for greater than one hundred and eighty (180) consecutive days. Minor Repair - the replacement of existing work with equivalent materials for the purpose of its routine maintenance and upkeep, but not including the cutting away of any wall, partition thereof, the removal or cutting of any structural beam or bearing support, or the removal or change of any requirements of egress, or rearrangement of parts of a structure affecting the exitway requirements; minor repairs shall not include the addition to, alteration of, replacement or relocation of any standpipe, water supply, sewer, drainage, drain leader, gas, soil, waste, vent or similar piping, electric wiring or mechanical or other work affecting public health or general safety.
Obstruction - any wall, dam, wharf, embankment levee, dike, pile abutment, projection, excavation, channel, rectification, culvert, building, fence, stockpile, refuse, fill, structure, or matter in, along, across or projecting into any channel, watercourse, or flood-prone area, which may impede, retard, or change the direction of the flow of water either by itself or by catching or collecting debris carried by such water or is placed where the flow of the water might carry the same down stream to the damage of life and property.
One-Hundred Year Flood- a flood, that on the average, is likely to occur once every one-hundred (100) years or, that has one percent (1%) chance of occurring each year although the flood may occur in any year.
Regulatory Flood Elevation - the one-hundred (100) year flood elevation plus a freeboard safety factor of one and one-half feet (1" ft.).
Special Permit - a special approval which is required for hospital, health care, and storage facilities and jails when such development is located in all, or a designated portion of a floodplain.
Structure - anything constructed or erected on the ground or attached to the ground including, but not limited to buildings, sheds, and other similar items.
Subdivision - the division or redivision of a lot, tract, or parcel of land by any means into two (2) or more lots, tracts, parcels or other divisions of land including changes in existing lots lines.
Substantial Improvement - any repair, reconstruction, or improvement of a structure, the cost of which equals or exceeds fifty percent (50%) of the market value of the structure either:
(a) Before the improvement or repair is started; or
(b) If the structure has been damaged, and is being restored, before the damage occurred.
