1003 PERMITS

1003.1 Emission reductions that must be achieved to meet the requirements of this Chapter and will require modification of equipment or operations at an affected facility shall be subject to the requirements of Chapter 2 of this Title.

1003.2 An operating permit issued pursuant to Chapter 3 for each budget source shall:

(a) Prohibit NOx emissions during each control period from exceeding the amount of allowances held in the budget source's compliance account for the control period as of the allowance transfer deadline;

(b) Authorize trading allowances for the purpose of complying with this Chapter; and

(c) Identify the budget source's NATS compliance account and AAR.

1003.3 No revision of an operating permit shall be required for increases or decreases in emissions authorized by allowances acquired or transferred, provided that the action complies with this Chapter and the authorization for trading contained in the permit.

1003.4 No revision of an operating permit shall be required for increases or decreases in allowances held by a budget source that are acquired or transferred pursuant to this Chapter and the authorization for trading contained in the permit.
