1002.1 The initial allocation of allowances by budget source is described in Table 10.1:

1002.2 The Director may modify the list of budget sources that have been allocated allowances in Table 10.1 to include sources that opt in pursuant to § 1000.3. The Director shall record, maintain, and annually transmit to the Administrator any modification of Table 10.1 after adopting the initial allocation, by January 1st of each year, after providing notice and opportunity for public comment.

1002.3 A budget source that reduces emissions during the control period and transfers the emission reductions as offsets to sources outside of this program shall be subject to deduction of allowances equal to the reductions moved off budget. This requirement does not apply if the new or modified source receiving offsets from a budget source opts in before the date construction approval is granted.

1002.4 Budget sources that cease to operate after the date of allocation will continue to receive allowances for each control period in the allocation period, unless the source files a request to reallocate allowances pursuant to § 1004.8.

1002.5 Nothing in this Title shall be construed to limit the Director's authority to allocate, condition, limit, suspend, or terminate any allowance.
