D.C. Mun. Regs. tit. 20, § 1001
1001.1 No later than December 31, 2000, and each December 31st thereafter, the owner or operator of each budget source shall hold a quantity of allowances in the budget source's current year NOx Allowance Tracking System (NATS) account, as described in Section 1006, that is equal to or greater than the total tons of NOx emitted from that budget source during that year's control period.
1001.2 A budget source that begins operation after the initial allocation has been made shall obtain allowances to operate during the control period. Allowances may be obtained from existing budget sources.
1001.3 Allowances shall not be used to meet or exceed limitations of any permit or regulation unrelated to this Chapter.
1001.4 A budget source may achieve compliance by:
(a) Reducing NOx emissions from the budget source;
(b) Acquiring allowances from another budget source consistent with applicable federal requirements; or
(c) A combination of the options in paragraphs (a) and (b).
