Commission Action
Authority: Unless otherwise noted, the authority for this chapter is Paragraph 21 of §8 of An Act Making appropriations to provide for the expenses of the District of Columbia for the fiscal year ending June thirtieth, nineteen hundred and fourteen, and for other purposes, approved March 4, 1913 (37 Stat. 977); as amended by §2 of the Public Utilities Amendment Act of 1989, D.C. 2313.1 Upon referral of the matter to the Commission for formal resolution, the Commission shall take any of the following actions:
- (a) Seek an injunction or mandamus in D.C. Superior Court in cases in which immediate action is necessary;
- (b) Issue a show-cause order or schedule a hearing requiring the operator to demonstrate why the operator should not be subject to the penalties set forth in the D.C. Code and this chapter; or
- (c) Pursuant to a hearing, order an operator to take corrective action.
2313.2 Failure to obey a Commission order can result in penalties prescribed in the D.C. Code and this chapter.
