3027.1 The Commission may take a proposed action at the close of the hearing pursuant to §§ 3021 and 3022, or at a later time when the record is closed.

3027.2 In a rulemaking under § 3021, the following shall apply:

1. (a) A proposed decision to amend the text of the Zoning Regulations or the Zoning Map shall be published in the D.C. Register as proposed rulemaking; and
2. (b) A proposed decision not to amend the text or map shall not be published in the D.C. Register.

3027.3 In a contested case under § 3022, a proposed decision shall not be published in the D.C. Register.

3027.4 The Commission need not take proposed action with respect to an application for Zoning Commission review and approval pursuant to Chapters 16, 18, and 28 of this Title, as well as §§ 1709.21 and 2523.2, but may take final action in accordance with § 3028, either at the close of the hearing or at a subsequent public meeting and, in the case of an application pursuant to § 2523, at the initial public meeting regarding the application.
