20.000 EXECUTIVE DIRECTOR RULES – THE PROCEDURE FOR AWARDING GAMBLING
ADDICTION GRANTS
20.100 GENERAL PROVISIONS [Eff. 9/1/15]
Pursuant to Section 12-47.1-701(2)(a)(III), C.R.S., of the moneys transferred to the limited gaming impact account and the gambling addiction account, two percent (2%) shall be used to award grants for the provision of gambling addiction counseling, including prevention and education, to Colorado residents.
20.200 GRANT ADMINISTRATION [Eff. 9/1/15]
Five percent (5%) of the moneys in the gambling addiction account may be used by the Colorado Department of Human Services to cover the direct and indirect cost of administering the grant program.
20.300 COUNSELING GRANT APPLICATION AND AWARDING PROCEDURE, AND CRITERIA FOR
GRANT AWARDEES [Eff. 9/1/15] A. Counseling Grant Awards Counseling grants must be awarded to entities that have completed or completed at least half of the gambling counseling training required for national certification for gambling addiction counselors as identified in Sections 20.300, B, 2 through 20.300, B, 4, below. These grants must be awarded to:
1. State or local public or private entities; and, 2. Behavioral health professionals or programs; and,
3. Entities that provide direct gambling addiction counseling services to Colorado residents.
B. Counseling Grant Applications Counseling grant applicants must meet the following requirements as identified from the National Certified Gambling Counselor (NCGC) program:
1. Bachelor’s degree in a behavioral health field; and, 2. A minimum of fifteen (15) hours of approved gambling specific training or education with appropriate supporting documentation; and, 3. A minimum of fifty (50) hours as a gambling counselor delivering direct treatment to problem/pathological gamblers and significant others; and, 4. A minimum of two (2) one-hour sessions of approved supervision/consultation with an international gambling counselor board approved clinical consultant.
C. Counseling Grant Application Procedure 1. Counseling grant applications must be requested from the gambling addiction grant program administrator at the Office of Behavioral Health. The application must:
2. Applications will be reviewed by the gambling addiction grant program administrator. Grants will be awarded to applicants who meet the necessary criteria for consideration as listed in Section 20.300, B. The amount of moneys awarded to grant recipients will be determined based on Section 20.310, A.
3. Within thirty (30) calendar days after submitting the application, a written grant approval or denial notice will be mailed to the applicant.
4. Awardees must re-apply for counseling grants each fiscal year.
20.310 AWARDING ADDICTION COUNSELING GRANTS AND ACCESS TO GRANT MONEYS [Eff.
9/1/15] Eighty-five percent (85%) of the moneys in the gambling addiction account must be awarded, as grants, to the entities identified in Section 20.300, A.
A. Counseling grant award amounts will be determined and prioritized by the amount of moneys in the gambling addiction account and the number of accepted awardees;
B. The pre-determined grant award moneys will be accessed by providing an invoice for reimbursement for provided gambling addiction counseling services to the Office of Behavioral Health. Invoices must include:
1. Date(s) of counseling session(s); and, 2. Length(s) of counseling session(s); and, 3. Cost per session; and, 4. Total amount of money requested.
C. Services already covered by other public funds or third party payers are not eligible for reimbursement through these funds.
D. If an awardee exceeds the grant award amount within the fiscal year, a one-time petition may be submitted to the Office of Behavioral Health requesting additional funds. The petition must contain:
1. A letter explaining the need for additional moneys; and, 2. The amount requested.
E. If the awardee does not fully expend the amount allocated to them for counseling services within the fiscal year, the unexpended funds in the counseling grant fund will carry over to the next fiscal year to be reallocated to awardees in the subsequent grant cycle.
20.400 GAMBLING ADDICTION TRAINING GRANTS [Eff. 9/1/15]
A. Ten percent (10%) of the moneys in the gambling addiction account must be awarded, as grants, to addiction counselors pursing national accreditation as gambling addiction counselors.
B. Pursuant to Section 24-102-201, C.R.S., an organization will be selected to be a contractor for the gambling addiction training grants administration program, as defined in Section 24-101- 301(6), C.R.S., in accordance with the Colorado procurement rules as found in the Colorado Department of Personnel and Administration rules (1 CCR 101-9).
1. The Office of Behavioral Health will select an organization to be the training grant contractor through a Request for Proposal (RFP) process, as defined in Section 24-103- 203, C.R.S., in accordance with the Colorado procurement rules (1 CCR 101-9).
2. Gambling addiction training grants must be used to:

20.410 TRAINING GRANT APPLICATION AND AWARDING PROCEDURE AND CRITERIA FOR
GRANT AWARDEES [Eff. 9/1/15] A. Training grant applicants must meet the following requirements:
1. Bachelor’s degree in a behavioral health field; and, 2. Certified Addiction Counselor II or higher.
B. Training grant application procedure:
1. Training grant applications must be requested from the training grant contractor identified in Section 20.400, B;
2. Once the application is completed, signed, and dated, it shall be mailed to the training grant contractor identified in Section 20.400, B;
3. Grant applications must contain the applicant’s Certified Addiction Counselor II number and expiration date;
4. Within thirty (30) calendar days after submitting the application, a written grant approval or denial notice will be sent to the applicant by the training grant contractor;
5. Awardees must re-apply for training grants each fiscal year.
6. The contractor will determine and prioritize gambling addiction training grants by the amount of moneys in the gambling addiction account and the number of accepted awardees.
C. Verification must be obtained that the grant awardees have attained their national certification as a gambling addiction counselor.
1. The training grant awardee has two years to complete the national accreditation;
2. The Office of Behavioral Health will consider repayment of a training grant award for individuals who received the grant but did not obtain accreditation.
20.500 APPEALS PROCESS FOR COUNSELING GRANTS AND TRAINING GRANTS [Eff. 9/1/15]
A. Applicants have fourteen (14) calendar days from the time of the written grant denial to appeal the decision, appeals must contain:
1. Written statement requesting an appeal; and, 2. Supporting information; and/or, 3. Missing application information.
B. Appeals must be sent to the gambling addiction grant program administrator at the Office of Behavioral Health.
C. Within thirty (30) calendar days of submitting the appeal, a written decision notice will be sent to the applicant by the Office of Behavioral Health.
D. If the applicant disagrees with the decision by the Office of Behavioral Health, applicants can request that the Colorado Department of Human Services, Office of Appeals, reconsider the decision. A request for reconsideration must:
1. Be in writing; and, 2. Be filed within fifteen (15) calendar days of the date provided on the decision notice form the Office of Behavioral Health.
20.600 REPORTING [ Eff. 9/1/15]
The Office of Behavioral Health must submit a yearly report, by January 1, to the Health and Human Services Committee of the Senate and House of Representatives. These reports must detail:
A. The amount of moneys allocated to the gambling addiction account;
B. The number of grant applications received; and, C. The amount of money requested; and, D. The total amount of money awarded; and, E. The persons receiving the grants; and, F. The dollar amounts awarded to each person.
