2288-R-1.00 Statement of Basis and Purpose The statutory basis for these rules adopted as emergency rules on December 14, 2006, is found in 22-2- 106(1)(a) and (e), state board duties; 22-2-107(1)(c), state board powers; and 22-88-102(1); C.R.S. The accessible educational materials for students with print disabilities grant program requires the State Board of Education to promulgate rules in accordance with Article 4 of Title 24, C.R.S. The rules shall include but not be limited to: time frames for submitting grant program applications; criteria for awarding a grant; time frame for distribution of grant moneys; reporting requirements for grant recipients; reporting and progress evaluation procedures; and other criteria the board may deem appropriate. 2288-R-2.00 Definitions 2.01 (1) Organization means a nonprofit or not-for-profit organization that is operating pursuant to 26 U.S.C. Sec. 501 (c) of the federal "Internal Revenue Code of 1986", as amended.

2.01 (2) Student with a print disability means a student enrolled in kindergarten or one of grades one through twelve, including in an eligible facility, who experiences difficulties in achieving the state model content standards adopted pursuant to section 22-7-406 and for whom the student's school district does not receive state or federal moneys for special education services either directly from the department or through an administrative unit. 2288-R-3.00 Eligibility and Implementation 3.01 (1) The Department of Education shall administer the grant program. Upon board approval of administrative rules the department shall develop and make available on its website a request for proposal (RFP) for distributing accessible educational materials to students with print disabilities as defined in 2.01 (2) of these rules.

3.01 (2) Eligible organizations shall have a statewide presence; have knowledge of assistive technology needs throughout the state; have a statewide infrastructure for staffing, equipment, training, and other services; and be able to distribute assistive technology equipment and other services through a statewide loan bank targeted toward students with print disabilities.

3.01 (3) Applications shall be distributed on or before December 15, 2006 and awarded on or before January 30, 2007 in year one of the program. Subsequent applications shall be distributed annually on or before September 1 and awarded on or before October 30. The program shall end on July 1, 2009.

3.01 (4) Grant awards may not result in payment of an aggregate amount of more than one hundred thousand dollars in any fiscal year; organizations receiving grants in year one shall be eligible for funding in successive years if the organization continues to meet the goals established in its application.

2288-R-4.00 Grant Application Procedures The application shall include the elements and criteria described in section 22-88-103(1). The department shall review the applications and make recommendations for funding to the state board. To the extent possible, recommendations shall consider geographic distribution and organizations with a statewide presence.

2288-R-5.00 Reporting 5.01 (1) Organizations receiving grants under this program shall report progress to the department on or before October 1, 2007, and on or before October 1 each year thereafter. Reports shall include the elements and criteria pursuant to section 22-88-105 (1)(a)-(d).

5.01 (2) On or before January 1, 2008, and on or before January 1 each year thereafter, the department shall submit a report to the governor pursuant to 22-88-105 (2)(a)-(c).
