I. PURPOSE The purpose of these rules and regulations is to set forth the procedures for the public to obtain the approval of the Department of Highways for the temporary closing of all or a portion of state highway in order to conduct thereon a special event or civic function, including but not limited to a bicycle or foot race, parade or celebration, and to minimize the inconvenience to the traveling public caused by the occurrence of such events on state highways. A statement of the basis and purpose of these rules and regulations is set out in the fiscal statement submitted to the legislative drafting office. I I. APPLICABILITY The rules and regulations are applicable to special events or civic functions which may require or necessitate the temporary closing of a state highway, or the rerouting of state highway traffic. II I. STATUTORY AUTHORITY Sections 42-4-410(6); 43-1-105(1)(j), C.R.S. 1973, as amended. IV . DEFINITION As used in these rules and regulations, the temporary closing of a highway by local authorities means any shutting-off, blocking, rerouting, or other restriction of the normal use of a highway. V . PROCEDURE A. Notice by sponsor. The sponsor or other person responsible for an activity described in I. above which is to take place on a state highway shall, at the earliest opportunity, give notice of intent (see enclosed form) to the District Engineer of the Department of Highways where the portion of highway is located. A form of notice (encl.) may be obtained at any district office, or at the headquarters of the Department. The Department will normally require at least thirty (30) days to review the notice of intent and consult with applicants, where necessary, prior to making a decision. This time may be extended if necessary to provide for the closure of the highway by local authorities.
B. Review of notice. The District Engineer shall review the notice of the proposed event in coordination with the State Patrol Captain in the district and the local authorities within whose jurisdiction the event is to take place.
C. Action by local authorities. Local authorities within their respective jurisdictions may by ordinance or resolution (or other action consistent with state statute) provide for the temporary closing to vehicular traffic of any portion of a highway during a specified period of the day for the purpose of celebrations, parades, and special local events or civic functions when in the opinion of said authorities such temporary closing is necessary for the safety and protection of persons who are to use that portion of the highway during the temporary closing. Section 42-4-410(6)(b). D. Approval by Department of Highways. Any temporary closing of a street which is a state highway and any rerouting of state highway traffic shall have the approval of the Department of Highways before such closing and rerouting becomes effective. Section 42-4-410(6). E. State/Local agreements. The Department of Highways (District Engineer and State Patrol Captain), local municipal authorities, and local county authorities shall enter into agreements with one another for the establishment, signing, and marking of appropriate detours and alternative routes which jointly affect state and local road systems. Section 42-4-410(6)(c). The sponsor may be requested to participate in the preparation of such agreement and to provide additional information not contained in the notice of intent.
F. Notice to sponsor. The District Engineer shall within twenty (20) days of receipt of notice inform the sponsor in writing of the action taken on the notice, including the recommended approval or disapproval of a temporary closing determined to be necessary by local authorities; and any rerouting of state highway traffic. The District Engineer shall state the reasons for his recommended action.
V I. APPEAL OF STATE ACTION A. The sponsor may appeal in writing within five (5) working days to the Chief Engineer the recommended action of the District Engineer, or such action shall become final. B. The Chief Engineer shall within five (5) working days of receipt of the appeal inform the sponsor of his decision. The sponsor may appeal in writing within five (5) working days to the Executive Director the decision of the Chief Engineer, or such decision shall become final. The sponsor shall be promptly notified of the decision of the Executive Director and this decision shall be final.
