Basis: The statutory basis for this regulation is 42-3-144. Purpose: The purpose of this regulation is to provide guidelines for a retail motorized bicycle business to act as an agent for the Department in the registration of the motorized bicycle. Agent Eligibility.
Any retail seller of a motorized bicycle (also known as “moped”) may act as agent for the department for the purpose of registration of motorized bicycles, provided the following conditions are met 1. An application and agreement is submitted on forms provided by the Department of Revenue, Motor Vehicle Business Group, Registration Section, with the following provisions: i) All monies received from the registration of Motorized Bicycles shall be kept in a separate fund for the benefit of the State of Colorado and, in the event of the death or insolvency of the agent, the State of Colorado shall have a preferred claim and shall not be stopped from asserting such claim by reason of the commingling of funds or otherwise; ii) Such agent shall keep, in a manner prescribed by the Department, a complete record of all registrations sold;
iii) Such agent shall keep all registration forms and decals at the place of business of the agent at all times;
iv) Such agent shall make reports and remittances to the Department of Revenue, Motor Vehicle Business Group, Registration Section, 1881 Pierce Street, Lakewood, CO 80214, for all registration fees for the month on or before the 10th day of the following month on forms furnished by the Department;
v) Such agent shall pay all postage on reports and remittances to the Department of Revenue, Motor Vehicle Business Group, Registration Section, 1881 Pierce Street, Lakewood, CO 80214;
vi) Such agent shall permit employees of the Department of Revenue to examine all registration documents and audit records pertaining to the sales of Motorized Bicycle Registrations; vii) Such agent shall return all unused decals, including voided and spoiled registration documents and decals for the year not later than the 15th day of January of the following year;
viii) Such agent shall read and study all instructions and rules and regulations; ix) The agent is personally liable for all registration forms or decals and shall maintain such items in a secure place at all times.
2) Such agent has received an approved application and agreement from the Department; 3) Such agent has a sales tax license issued by the Department of Revenue. 4) Such agent shall maintain an established place of business in a location approved for such business by local zoning regulations;
5) Such agent shall maintain regular office hours and is open for business no less than forty (40) hours per week. Office hours posted and readable from outside the premises.
