DEPARTMENT OF REVENUE Division of Motor Vehicles RULES GOVERNING ACCESS TO IMAGES RECORDED FROM DRIVER LICENSES AND IDENTIFICATION CARDS 1 CCR 204-24 [Editor’s Notes follow the text of the rules at the end of this CCR Document.] _________________________________________________________________________ Authority: This rule is promulgated under the authority of § 42-2-114(1)(a)(IV) and (V) C.R.S. Definitions: “Image Comparison Technology” means any technology that is utilized to compare biometric data including facial images.
Permitted Uses: Permitted uses of images or image comparison technology shall be in accordance with § 42-2-114(1)(a)(IV) and (V).
Requests for image comparison (facial recognition) shall be submitted to the Department in a format supplied by the Motor Vehicle Business Group. Requests shall contain the following information:
1. Subject name and date of birth or subject name and Colorado PIN number. (Subject of image comparison must be under reasonable suspicion for committing a crime or will commit a crime.) 2. Name and address of agency requesting the image comparison.
3. Name and title of agent for the agency requesting the image comparison.
4. Purpose of the request.
5. Case number.
Image comparison processing. The Department shall set process standards for image comparison. Time requirements for the Department to process image comparison requests from federal, state, or local government agencies will be determined by the availability of the image comparison network, volume of requests, and the available resources.
