BASIS, PURPOSE AND STATUTORY AUTHORITY The basis and purpose of this rule is to facilitate the efficient use of telephone numbers by imposing self regulation with respect to the assignment of telephone numbers. Specifically, the rules provide for the efficient use of telephone numbers in all Colorado numbering plan areas to allow for the future sharing of telephone numbers between telecommunications service providers, i.e., number pooling. Number pooling has been recognized by the North American. Numbering Council and the Colorado Public Utilities Commission as being in the public interest. Number pooling will permit more efficient assignment of telephone numbers within a numbering plan area. In order to gain the benefits of number pooling in the future, it is imperative that the Commission require all central office code holders to manage telephone numbers to allow for future reclamation of unused numbers. The statutory authority for the Commission's rulemaking authority is found at § 40-2-108, C.R.S. The statutory authority for numbering administration is found at § 40-15-503(2) (b) (II), C.R.S., and 47 U.S.C. § 251 (e) (1) . The implementation of the federal statute is found at 47 C.F.R. Part 52.19. RULE (4 CCR) 723-49-1. APPLICABILITY.
These rules are applicable to all persons, including providers of telecommunications services, who have accepted assignment of and make use of central office codes in Numbering Plan Areas assigned to Colorado, who accept assignment of and make use of initial central office codes in Numbering Plan Areas assigned to Colorado during the effectiveness of this Rule, or who assign telephone numbers in any Numbering Plan Area assigned to Colorado.
RULE (4 CCR) 723-49-2. DEFINITIONS.
723-49-2.1 Central Office Code means the second three digits (NXX) of a ten-digit telephone number in the form NPA- NXX-XXXX. A central office code is also called an NXX code. The “N” denotes numbers two through nine and X denotes numbers 0 through 9.
723-49-2.2 Central Office Code Administrator means the entity(ies) responsible for the administration of the NXXs within an NPA.
723-49-2.3 Contaminated Block means any thousand block of telephone numbers where more than ten percent of the numbers in the block have been assigned to subscribers. 723-49-2.4 Numbering Plan Area (NPA) means the first three digits of a ten-digit telephone number in the North American Numbering Plan. This is also called an area code. NPAs are classified as either geographic or non-geographic.
723-49-2.5 NXX Code Holder means any telecommunications service provider that has been assigned at least one central office code by the Central Office Code Administrator. 723-49-2.6 Thousand Block means a group of a thousand telephone numbers within a single. NXX code, e.g., numbers NXX- 1000 through NXX-1999 constitute a thousand block. RULE (4 CCR) 723-49-3. ASSIGNMENT OF TELEPHONE NUMBERS IN COLORADO. 723-49-3.1 All NXX code holders with numbers assigned to the NPAs in the State of Colorado (303, 719, 970, 720, or any future NPAs assigned to Colorado) shall assign numbers from a single thousand block within an NXX until that thousand block is within 60 days of exhaust, i.e., all numbers in that thousand block are assigned to an end user, or are unassignable or reserved due to internal testing, number aging/cooling, or planning.
723-49-3.1.2 Notwithstanding Rules 3.1 and 3.1.1., an NXX code holder may fill a bona fide request for a consecutive block of numbers (e.g., to meet Private Branch Exchange (PBX) requirements) which cannot be met by the vacant numbers of the thousand block currently being utilized for assignment even if the creation of multiple contaminated blocks within an NXX is the result.
723-49-3.2 The Central Office Code Administrator must perform its central office code administration functions in such a manner as to support these Rules. This includes issuing with any NXX code assignment made after the effective_ date of these Rules written notice to the NXX code holder of the thousand block integrity requirement set forth in Rule 3.1. 723-49-3.3 Upon implementation of any number pooling between telecommunications service providers in Colorado, NXX code holders participating in pooling must make uncontaminated thousand blocks available to the appropriate administrator for possible reassignment to other providers in a number pooling process.
723-49-3.4 All NXX code holders shall provide services in such a manner as not to encourage the inefficient use or depletion of telephone numbers in any Colorado NPA. RULE (4 CCR) 723-49-4. WAIVER.
Any NXX code holder seeking relief from the requirements of these rules shall request a waiver by the filing of an application. The application shall be noticed for 10 days, unless a shorter period is requested and approved by the Commission. Upon good cause shown, the Commission may grant the requested waiver.
