4 CODE OF COLORADO REGULATIONS (CCR.) 723-43 BASIS, PURPOSE, AND STATUTORY AUTHORITY.
The statutory authority for these rules is found in Sections 40-3-101(2), 40-3-102, 40-3-103, 40-3-106(1) (a), 40-3-107, 40-3-110, and 40-4-101, C.R.S. which empower the Commission to establish standards for the adequacy of public utility services, including the timely provisioning of adequate telephone service and regulated telecommunications services, and require the Commission to prescribe rules and regulations for the performance of any service or the furnishing of any commodity by a public utility, to enforce those rules and regulations as well as to require any necessary reporting of said performance. The Commission is also authorized to promulgate rules generally by Section 40-2-108, C.R.S., and specifically for telecommunications services by§§ 40-15-201, 40-15-302, and 40-15-503(2) C.R.S., in order to implement the provisions of Title 40, Article 15, Parts 2, 3, and 5, C.R.S. In addition, the Telecommunications Act of 1996, codified at 47 U.S.C.§ 151 et seq., (the “Act”) requires incumbent Local Exchange Companies (“incumbent telecommunication providers”) to provide service to a competitive local exchange company (“competing telecommunication providers”) that is at least equal in quality to that provided by the incumbent local exchange carrier to itself or any competing carrier. See Section 252(c)(2) of the Act. The Federal Communications- Commission (“FCC”) amplified on the responsibilities of incumbent telecommunication providers to provide such service and of the States to oversee such requirements under the Act. See FCC Order in CC Docket 96-98 at ¶¶ 25, 101, 133-137, 224, 225, 310, 523, 970.1 As further noted by the FCC, reporting mechanisms are necessary to establish, track and enforce incumbent telecommunications provider's provision of nondiscriminatory service. See FCC Order in CC Docket 96-98 at ¶ 311 and FCC Order in CC Docket 96-149 at ¶¶ 242, 243; Implementation of the Non-Accounting Safeguards of Sections 271 and 272 of the Communications Act of 1934, as Amended, First Report and Order, CC Docket No. 96-149 (December 24, 1996). 1See In the Matter of Implementation of the Local Competition Provisions in the Telecommunications Act of 1996; Interconnection Between Local Exchange Carriers and Commercial Mobile Radio Service Providers, CC Docket Nos. 96-98 & 95-185, First Report and Order (released August 8, 1996) (“First Report and Order”). In § 252 . (e) (3) the Act specifically states:
The basis and purpose of these regulations is to require: 1) monitoring and statistical testing of service quality measurements for performance parity between the service provided by the incumbent telecommunications provider to competing telecommunications providers and service provided by the incumbent telecommunications provider to its other customers; 2) minimum standards that all incumbent telecommunications providers must meet when providing products or services to competing telecommunications providers 3) reporting of statistical testing results and reporting to demonstrate actual performance in comparison to the minimum standards and 4) financial credits to competing telecommunications providers to ensure that incumbent telecommunications providers are meeting their minimum performance obligations so that an adequate and timely level of basic telephone service and regulated telecommunications service can be provided to the public. These provisions will assist the Commission in implementing the competitive mandates of the Act as well as§§ 40-15-501, C.R.S. et seq. These rules are necessary to reflect the present and continuing evolution of a competitive telecommunications market which is expected by the public. These rules are issued pursuant to§40-15- 501, et. seg., and 40-2-108, C.R.S.

723-43-10.1. Service Order Provisioning Commitment Missed. RULE 4 CCR 723-43-1.APPLICABILITY.
The standards within these rules apply to the offering of interconnection, resale and unbundled network elements by incumbent telecommunications providers as defined in 4 CCR 723-39-2.10 (Rules on Interconnection and Unbundling).
The standards within these rules do not apply to rural telecommunications providers as defined in 4 CCR 723-39-2.17 - unless the exemption under 4 CCR 723-39-9 for providing interconnection and network elements has been terminated through the issuance of a final order by the Commission. RULE 4 CCR 723-43-2.EXPIRATION DATE.
These rules shall expire on June 30, 2004 unless extended by issuance of a final order as a result of rulemaking by the Commission before the date of expiration. RULE 4 CCR 723-43-3.DEFINITIONS.
The meaning of terms used within these rules shall be consistent with their general usage in the telecommunications industry unless specifically defined by Colorado statute or this rule. The definitions contained in 4 CCR 723-2-2 and 4 CCR 723-39-2 shall also apply. As used in these rules, unless context indicates otherwise, the following definitions shall apply: 723-43-3.1 Basic Rate Interface (“BRI”) refers to the Basic Rate Interface of the ISDN (“Integrated Services Digital Network”) and provides two bearer (B) channels each having a nominal capacity of 64 kbit/sec and one data (D) channel with a nominal transmission rate of 16 kbit/sec.
723-43-3.4 Committed due date is the date shown on the firm order confirmation or, for orders that do not have a firm order confirmation, the date entered on the service order, or the service interval date established by the incumbent telecommunications provider if no specific commitment due date is normally provided.
723-43-3.5 Critical value, α, is defined as one minus the confidence interval to be used to judge equality between the actual data of the competing telecommunications provider and the incumbent telecommunications provider.
723-43-3.6 Customer service record (“CSR”) means the record of services for an end-use customer.
723-43-3.7 Dedicated Services means private line and switched access services as defined in§ 40-15-102(22) and (28), C.R.S., respectively.
723-43-3.8 Delayed order is an order that did not meet the committed due date. 723-43-3.9 Digital Signaling Levels 0, 1 and 3 (“DSO”. “DS1”. and “DS3”) means: DSO is the digital equivalent of the information transfer rate of the typical analog loop, nominally 64 kbits/second. A DS1 is nominally equivalent to 24 DSO channels and a DS3 is equivalent to 28 DS1s, or 672 DSOs.
723-43-3.10 Failed Query Notice is a notification from the electronic pre-ordering system that the data request failed to be completed (i.e. could not be processed by that system). 723-43-3.11 Modified Standard Error of the Difference of the Sample Means. σD, is the product of two factors. The first factor depends on the number of observations in the incumbent telecommunications provider and competing telecommunications provider samples, and is the square root of the sum of the reciprocals of these sample sizes. The second factor depends on whether one is dealing with a measured variable, a proportion, or a rate. For a measured variable, this factor is the square root of the variance of the incumbent telecommunications provider'sample. Algebraically, σ2 = the. variance of the incumbent telecommunications provider observations for the month nc = the number of competing telecommunications provider observations for the month; ni = the number of incumbent telecommunications provider observations for the month; When the specified test parameter is a proportion, the second factor is pi* (I - pi). Thus: ρl = the proportion for the incumbent telecommunications provider sample data. When the specified test parameter is a rate, the second factor, is rl * (1 - rl} . Thus: rl = the rate for the incumbent telecommunications provider sample data. 723-43-3.12 Optical Carrier-Level 1 Signal (“OC1”) is the designation for transmission over fiber optic facilities of the synchronous transport signal-level 1 which is a 51.84 Mbits/second rate of data transmission and is equivalent to 810 64 kbits/second channels. Higher levels of optical data transmission speeds are integer multiples of this OC1 transmission rate. 723-43-3.13 Permutation Test is a statistical test procedure that does not rely on assumptions regarding the distribution of the observations. Given data from both the incumbent telecommunications provider and the competing telecommunications provider, and the definition of the test statistic (i.e. the modified Z statistic), the observations are pooled into one set and redistributed between the incumbent telecommunications provider and the competing telecommunications provider in all possible ways using data set sizes of the same size as the actual data sets. For each way, the test statistic is calculated. . The actual observed value of Z is judged to be significant (at some chosen level, for example 5%) if it falls within the chosen level (i.e., the upper 5%) of this set of calculated values. The method can be applied either to measured variables, where it is possible to economize on computation by using only a (large) random sample of relabelings, or can be applied to counted variables, (proportions), when it can be performed without actually enumerating all the possible relabelings. 723-43-3.14 Plain Old Telephone Service (“POTs”), for the purposes of these rules, means single line Basic Telephone Service furnished to a premise. 723-43-3.15 Pre-ordering Functions means the process of retrieving information about the current status of the products and services used by an end-use customer, the existing account (s) of that customer, and the set of products and services or network elements available to serve that customer in a given location.
723-43-3.16 Primary Rate Interface (“PRI”) refers to the Primary Rate Interface of the ISDN, i.e. ISDN (PRI), and provides 23 bearer (B) channels each having a nominal capacity of 64 kbits/second and one data (D) channel with a nominal transmission rate of 64 kbits/second. 723-43-3.17 Query Notice is a request for individual data from the pre-ordering system. 723-43-3.18 Z Statistic is the ratio of the difference between the mean values for two designated samples to the modified standard error of that difference. Thus: Z= 723_43_xmacron.jpgc - 723_43_xmacron.jpgi σd or Z= ρc - ρi σd 723_43_xmacron.jpgc is the mean of the monthly measurements for the competing telecommunications provider;
723_43_xmacron.jpgi is the mean of the monthly measurements for the incumbent telecommunications provider customers;
pc is the proportion for the competing telecommunications provider customers; pi is the proportion for the incumbent telecommunications provider customers; and σD is the modified standard error of the difference in the sample means, proportion or rate. RULE 4 CCR 723-43-4. GENERAL REQUIREMENTS.
The criteria for quality of service in these rules establish a minimally acceptable standard for the basic elements of telecommunications service and facilities. The rules do not attempt to establish all criteria for all service applications, nor do the rules establish the most desirable service level for any basic element. In the event a specific service element is not addressed by these rules, the provider shall meet generally accepted industry standards for that element and the total service. Organizations which are recognized for establishing standards that may be appropriate for telecommunications services provided in this state include the Institute of Electrical and Electronics Engineers (“IEEE”), the American National Standards Institute (“ANSI”), Bellcore, the Rural Utility Services division of the Department of Agriculture (“RUS”) and the Federal Communications Commission (“FCC”).
Unless otherwise noted, the standard reporting period for these measurements is monthly. 723-43-5.1 Order Processing Procedures 723-43-5.1.1 Average Interval for Firm Order Confirmation equals ∑(a - b)/c where, for UNE or resale orders:
b = date and time (in hours and minutes) of acknowledgment by the incumbent telecommunications provider that an order was received from the ordering party for each order in the reporting period; and c = total orders confirmed in the reporting period; or where, for orders that do not have FOCs:
a = date and time (in hours and minutes) an order is recognized as valid by the operational support systems of the incumbent telecommunications provider for each order in the reporting period;
b = the date and time (in hours and minutes) the order is input into the retail order processing system of the incumbent telecommunications provider for each order in the reporting period; and c = total orders confirmed in the reporting period.
Rejected orders and administrative orders shall be excluded from this measurement. Trouble reports included in this measurement shall be categorized by whether or not dispatch of service personnel by the incumbent telecommunications provider was required. To the extent electronic access exists or is required to be made available to competing telecommunications providers for the operational support systems of the incumbent required to perform pre-ordering functions, the electronic response to the pre-order query interval for no less than 95 percent of such queries in any month shall be ten seconds or less for each of the transaction categories in Rule 5.8.3 except for the facility availability, service availability, and rejected query notices categories. For these four categories the response time to queries from competing telecommunications providers shall be no greater than the incumbent telecommunications provider's retail response time plus 10 seconds until such time that the response times to queries from the customer service agents for the incumbent telecommunications provider are less than 10 seconds for two consecutive months. After the 10 second minimum standard is met by the incumbent telecommunications provider in response to its own queries for facility availability, service availability, and rejected query notices, the 10 second minimum standard shall apply to that category. Comparisons under this rule exclude the time necessary for manual interaction with the electronic system and only compare the initial electronic transaction without regard to equivalency in the amount of transmitted information. If the equipment utilized in . this function is not capable of tracking the response time for all pre-ordering queries, statistically significant sample timing tests performed by the Incumbent telecommunications provider(s), with assistance as necessary to conduct such tests from the competing telecommunications provider, shall be used to measure the monthly electronic access response time. If the competing telecommunications provider elects to use a means of access other than a direct electronic interface to the incumbent telecommunication Page 81 provider's operational support systems (e.g. fax), the response time requirements of this Rule shall not be applicable to queries by such alternative methods.
RULE 4 CCR 723-43-7. STATISTICAL ANALYSIS REQUIREMENTS AMD INTERPRETATION. 723-43-7.1 For the purpose of conducting statistical analysis on the service quality measurement data, a permutation test shall be conducted monthly using standard statistical software commercially available in the public domain.
723-43-7.3 The Z Statistic shall be calculated for each data set for either all permutations of the data or a maximum number of 1,000 permutations when the calculated number of permutations would exceed 1,000 permutations.
723-43-7.4 The data permutations shall be constructed by selecting a random sample, without replacement, from the pooled data of the actual data sets. The random sample shall be the same size as the sample size of the actual data for the competing telecommunications provider (i.e.
723-43-7.6 If the fraction computed in Rule 7.5 is; greater than the critical value, a, the results of the permutation test for the actual data samples shall not be recognized as supporting a determination for the reviewed measurement that the competing telecommunications provider is receiving inferior service relative to that which the incumbent telecommunications provider provides to itself or other reporting category as specified in these rules. 723-43-7.7 For the purposes of these rules, a statistical confidence level of 95 percent is reasonable for determination of a and for balancing the chances for the occurrence of a Type I statistical error (i.e. a false detection by the permutation test of inferior service for the competing telecommunications provider) to that for the occurrence of a Type II statistical error (i.e. that inferior service to the competing telecommunications provider is not detected by the permutation test).
RULE 4 CCR 723-43-8. REPORTING REQUIREMENTS.
723-43-8.2 The reports, data, and analysis required in Rule 8.1, except for the reports, data, and analysis for individual competing telecommunications providers, shall also be submitted to the Commission at the same time as it is provided to the competing telecommunications providers. The reports and data submitted to the Commission shall be presumed to be information subject to public inspection. An incumbent telecommunications provider claiming any of this information is. confidential shall file a written justification for such a claim at the time of filing of the document. The data shall be submitted to the Commission in both hard copy and electronic copy in the Commission's current spread sheet software platform.
723-43-8.3 The reporting format for the service quality measurements requiring actual performance data shall be as shown here:

RULE 4 CCR 723-43-9. NOTIFICATION AND STATUS REPORTING REQUIREMENTS. 723-43-9.1 Specific Requirements for Service Restoration Status Updates. For service outages attributable to the services, products or network elements provided by the incumbent, the incumbent shall provide a status report to the competing telecommunications provider at the time of initiation of repairs and within 30 minutes of completion of restoration of service. This Rule shall not preclude the competing telecommunications provider from making more frequent status queries to which the incumbent can respond as mutually agreed upon between the parties. 723-43-9.2 Voice/Automatic Response Unit Outage/Restoral Notification. For outages of voice or automated response systems (e.g. blockage of access or loss of facilities) used by the incumbent telecommunications provider to provide Directory Assistance or Operator Services to a competing telecommunications provider, the incumbent telecommunications provider shall provide a status report to the competing telecommunications provider within 15 minutes of the occurrence of the outage and within 15 minutes of completion of restoration of service. Additionally, the incumbent telecommunications provider shall notify the competing telecommunications provider in writing, within 3 “days of the outage restoration, of the cause of the outage and the actions the incumbent will take, if necessary, to prevent a similar occurrence in the future. This Rule shall not preclude the competing telecommunications provider from making more frequent status queries to which the incumbent can respond as mutually agreed upon between the parties. 723-43-9.3 Notification of Late Billing. When providing any late billing to a competing telecommunications provider, an incumbent telecommunications provider shall provide written documentation informing the billed party of that fact, the reasons for the late submittal and the actions it will take, if necessary, to prevent similar late billings in future billing periods. 723-43-9.4 Billing Inquiry Responsiveness. All billing inquiries of the competing telecommunications provider regarding usage data shall be responded to within 24 hours by the incumbent telecommunications provider. For inquiries received after 12:00 noon, the 24 hour response period shall not commence until 8:00 am the following business day. A permissible initial response from the incumbent within this time period may be that further investigation is required, provided an estimated date of completion is included with the response. RULE 4 CCR 723-43-10. PER OCCURRENCE CREDITS.
Absent agreement of the parties to the contrary, ”the following provisions relating to bill credits shall be incorporated into each interconnection agreement entered into between an incumbent telecommunications provider and a competing telecommunications provider pursuant to the provisions of 47 U.S.C. § 252: Appropriate adjustments to. the competing telecommunications provider's bill shall be made by the incumbent telecommunications provider in the form of per occurrence credits for violations of selected performance standards as set forth in these Rules, except as set forth in Rule 4.3, or in circumstances where the violation of performance standard is due to (1) the actions of another person other than the incumbent telecommunications provider or persons under the control or supervision of the incumbent telecommunications provider, including the competing telecommunications provider or that provider's end-use customer; (2) events not under the control of the incumbent telecommunications provider, including malfunctions of facilities other than those under the control of the incumbent telecommunications provider and the inability of the incumbent telecommunications provider to gain access to a customer's premise when required. Per Occurrence Credits are meant to provide an administratively efficient means of minimally compensating the competing telecommunications provider for failures of the incumbent telecommunications provider under these rules. The competing telecommunications provider may elect to forego the bill credits provided for in this Rule 10 and instead pursue other monetary remedies as may be provided for under applicable law. 723-43-10.1 Service Order Provisioning Commitment Missed. 723-43-10.1.1 For each instance of failure to meet a service order commitment date for facilities or service involving end-use customer specific orders within the intervals established within Rule 6.1 or, if longer, the date specified by the competing telecommunications provider, the incumbent telecommunications provider shall waive the installation non-recurring charge and 1 months recurring charge for the applicable service or element. When this credit is applicable, credits under Rule 10.3 shall not apply. In addition, a competing telecommunications provider may request and receive reimbursement from the incumbent telecommunications provider for any bill credits given by the competing telecommunications provider to an end-use customer for alternative service provided pursuant to Rule 723-2-24.
When this credit is applicable, credits under Rule 10.3 shall not apply. 723-43-10.2 Repair Time To Restore Interval Missed by More than 24 hours. For each instance of failure to complete restoration of a service or element within 24 hours after the end of the intervals established in Rule 6.2 or, if longer, the time specified by the competing telecommunications provider, except for DS1 and DS3 dedicated and transport services, the incumbent telecommunications provider shall provide a credit of 1 months recurring charge for the applicable service or element for each additional 24 hours past the first 24 hours after the specified interval (e.g. payment is required for a delay of 72 (24 + 24 + 24) or more hours for a 24 hour service restoral interval) . For DS1 and DS3 transport services, a credit of 1 months recurring charge shall be given for each additional 24 hours past the first 8 hours after the specified interval (e.g. for a delay of 36 (4 + 8 + 24) hours) . When this credit is applicable, credits under Rule 10.3 or 10.7 shall not apply.
723-43-10.4 Recorded Usage Data. Whenever more than 5 percent of customer usage data for a specific billing date is provided to the competing telecommunications provider's billing center beyond the sixth day of the date of call recording, as denoted by the AMA system of the incumbent telecommunications provider, a credit to the competing telecommunications provider's bill shall be provided by the incumbent telecommunications provider. The credit shall be. equal to an amount which is the product of the number of messages delayed beyond six days times the average revenue per message times 0.000493 per day (i.e. an annual percentage rate of 18 percent compounded daily for each day). The average revenue per message is determined from the revenue associated only with the delayed messages.
723-43-10.5 Signaling System 7 (“CCS7”) Network Event. For each instance of an outage due to Signaling links, Service Control Points, Signal Transfer Points, or required databases, as more fully defined within 4 CCR 723-39, that are due to the failure of the incumbent telecommunications provider's equipment, facility, or software or human/process errors on the part of the incumbent telecommunications provider, and that is greater than 2 seconds on the incumbent telecommunications provider's network, and which prohibits call completion and/or database service availability access for the competing telecommunications provider or its customers in this state, the incumbent telecommunications provider shall provide a credit to the competing telecommunications provider bill, if the outage generated a trouble report from the competing telecommunications provider. This credit shall be equivalent to 2 months recurring charges for all CCS7 services affected by the outage (i.e. those that were either out-of-service or unusable because of the outage) up to an amount of $25,000 per event. A credit does not apply for blockage due to inadequate provisioning of facilities on the incumbent telecommunications provider's network by the competing telecommunications provider to meet the traffic demand For this credit to be applicable, the competing telecommunications provider must have signaling links routed over diverse (i.e. physically separate) facilities, unless such facilities are unavailable from the incumbent telecommunications provider.
723-43-10.6 Routing to Operator Services/Directory Assistance Platform. For each instance of 1,000 or more calls to the competing telecommunications provider's operator or directory assistance services platform blocked due to the failure of the incumbent telecommunications providers' equipment, facility, or software or human/process errors on the part of the incumbent telecommunications provider, the incumbent telecommunication provider shall provide a credit to the competing telecommunications provider of $1 per blocked call up to $25,000 per event. A credit does not apply for blockage due to inadequate provisioning of facilities on the incumbent's network by the competing telecommunications provider to meet the traffic demand. 723-43-10.7 Customer Specific Service or Unbundled Element Performance. For each instance in which Resale Services or Network Elements do not meet regulatory standards adopted by the Commission for technical performance {e.g. insertion loss, noise, bit error rates, etc.) of the applicable element due to the failure of the incumbent telecommunications provider's equipment, facility,“ or software or human/process errors on the part of the incumbent, the. incumbent telecommunications provider shall provide a credit to the competing telecommunications provider of an amount of $2 per incident per line or per DSO equivalent circuit, per day from the date of notice or complaint by the competing telecommunications provider until the date compliance with the standard is restored.
