1. (a) Basis. This section implements section 1902(e)(7) of the Act.

2. (b) Requirement. The agency must provide Medicaid to an individual eligible and enrolled under § 435.118 until the end of an inpatient stay for which inpatient services are furnished, if the individual:

   1. (1) Was receiving inpatient services covered by Medicaid on the date the individual is no longer eligible under § 435.118 based on the child's age; and
   2. (2) Would remain eligible but for attaining such age.
