A grantee may, notwithstanding any requirement in 2 CFR part 200, incur pre-award costs as specified in 2 CFR 200.308(d)(1) unless—

1. (a) ED regulations other than 2 CFR part 200 or a statute prohibit these costs; or

2. (b) The conditions of the award prohibit these costs.
