Cal. Code Regs. tit. 14, § 18660.46 – Procedure for Imposing Civil Liabilities for Failure to Comply with Requirements for Manufacturers.

(a) The administrative procedure set forth in Section 18660.44(b)-(i) shall apply to any civil liability administratively imposed pursuant to Public Resources Code Section 42474(c).
(b) The hearing shall be governed by the informal administrative hearing procedures in Chapter 4.5 of Part 1 of Division 3 of Title 2 of the Government Code, commencing with Section 11400.
(c) Hearings held pursuant to this section are excluded from all regulations and procedures set forth in Chapter 1, Article 6 of Division 7 of Title 14 of the California Code of Regulations.

1. New section filed 10-5-2015 as an emergency; operative 10-5-2015 (Register 2015, No. 41). Pursuant to Public Resources Code section 42475.2(b), this is a statutorily deemed emergency, and the emergency language remains in effect until 10-5-2017 unless a Certificate of Compliance is transmitted to and approved by OAL, or the emergency language is revised by the Department prior to that date, whichever occurs sooner.

2. New section refiled 8-28-2017 as an emergency; operative 10-6-2017 (Register 2017, No. 35). Pursuant to Public Resources Code section 42475.2(b), this is a statutorily deemed emergency, and the emergency language remains in effect until 10-6-2019 unless a Certificate of Compliance is transmitted to and approved by OAL, or the emergency language is revised by the Department prior to that date, whichever occurs sooner.

3. Certificate of Compliance as to 5-30-2018 order transmitted to OAL 8-3-2018 and filed 9-17-2018 (Register 2018, No. 38).

4. New subsection (c) filed 6-24-2026 as an emergency; operative 6-24-2026 (Register 2026, No. 26). Pursuant to Public Resources Code section 42475.2(b), this action is a deemed emergency and shall remain in effect for a period of two years or until revised by CalRecycle, whichever occurs sooner. A Certificate of Compliance must be transmitted to OAL by 6-23-2028 or emergency language will be repealed by operation of law on the following day.
