In addition to filing a completed personal history record and personal financial questionnaire, along with all required releases and fingerprint cards, each limited partner applying for approval of delayed licensing shall provide the following information:
- (1) A listing of any other business interest between the applicant and a general partner existing prior to, at the time of, or after the formation of the limited partnership;
- (2) Whether the applicant has a familial relationship, either by blood, marriage, or adoption, with a general partner; and
(3)
- (A) A certification that the applicant does not have and will not have a material relationship to, or material involvement with, a general partner of the limited partnership with respect to gaming operations of the limited partnership, except in another licensed capacity under Arkansas Racing Commission rules in accordance with commission rules.
- (B) A person may be deemed to have a material relationship to, or material involvement with, a general partner if the person is a shareholder, controlling person, or key employee of a legal entity that is a general partner, or if the person, as an agent, consultant, advisor, or otherwise, exercises a significant influence upon the management or affairs of such general partner.
