(a) Except as otherwise specifically provided in 23 CAR §§ 89-106, 89-115, 89-116, 89-119, and 89-124, this part shall apply to:

1. (1) All Medicare supplement policies delivered or issued for delivery in Arkansas on or after the effective date of this part; and
2. (2) All certificates issued under group Medicare supplement policies which certificates have been delivered or issued for delivery in Arkansas.

(b) This part shall not apply to a policy or contract of one (1) or more employers or labor organizations, of the trustees of a fund established by one (1) or more employers or labor organizations, or a combination thereof, for:

1. (1) Employees or former employees, or a combination thereof; or
2. (2) Members or former members, or a combination thereof, of the labor organizations.
