(a)

1. (1) A provider agency may voluntarily relinquish its designation by providing notice to the State Long-Term Care Ombudsman and the area agency on aging in the relevant service area.
2. (2) Such notice shall be provided sixty (60) days in advance of the date of the relinquishment of designation.

(b) The provider agency shall:

1. (1) Surrender intact to the State Long-Term Care Ombudsman or his or her designee all:

   1. (A) Arkansas Long-Term Care Ombudsman Program case records;
   2. (B) Documentation of all program activities and complaint processing as required by the ombudsman reporting system; and
   3. (C) Identification cards of all ombudsman representatives associated with the provider agency;
2. (2) At the discretion of the Office of the State Long-Term Care Ombudsman, surrender any equipment purchased with funds designated for ombudsman services; and
3. (3) Surrender the balance of any advanced state or federal monies to the office.
