- (a) A person commits the crime of indecent exposure if, with intent to arouse or gratify sexual desire of himself or herself, he or she exposes his or her genitals under circumstances in which he or she knows the conduct is likely to cause affront or alarm.
(b)
- (1) Indecent exposure is a Class A misdemeanor.
(2) Notwithstanding subdivision (1), indecent exposure is a Class C felony under either of the following circumstances:
- a. If any victim of the offense is under 12 years of age.
- b. If the person has two or more prior convictions under this article.
