Appeal from an order of the Supreme Court, Mоnroe County (Kenneth R. Fisher, J.), entered February 15, 2007. The order, among other things, granted that рart of the motion of defendant Total Identity Corporation to compеl arbitration.
It is hereby ordered that the order so appealed from is unanimously reversed on the law without costs, that part of the motion of defendant Total Identity Corporation to dismiss the complaint is granted, the complaint against that defendant is dismissed, the cross motion is dismissed and plaintiff‘s motion is denied.
Memorandum: Plaintiff commenced this action seeking, inter alia, damages for the alleged breach by defendant Total Identity Corporation (TIC) of two amended stock purchase agreements.
