Background

  • James E. Carver was indicted for murder, a firearm specification, rape, having weapons while under disability, assault (lesser-included of domestic violence), and tampering with evidence arising from events Feb. 17–19, 2019; he was convicted by a jury and sentenced to 33 years to life.
  • Heather Camp was shot at close/near range with a .22 Ruger; autopsy showed a near‑range chest wound grazing the aorta, extensive internal bleeding, and blunt‑force injuries to head/face; death was homicide.
  • Carver gave a recorded interview to police in which he described multiple versions of the shooting, admitted sex with Camp after she was shot, and identified where the gun could be found; police recovered the Ruger and clothing with blood.
  • Forensic testing showed Camp’s and Carver’s DNA on nipple swabs and on the inside of a bloodstained boot; eyewitnesss (Kinnisons, Knisley) described Camp as badly beaten and in need of medical care.
  • Carver objected at trial under the corpus delicti rule to playing unredacted portions of his interview discussing sex; he also challenged sufficiency of evidence, arguing the killing was reckless rather than purposeful and that the sex was consensual.
  • The appellate court overruled both assignments of error and affirmed the convictions, holding (1) independent evidence satisfied corpus delicti for admission of his statements about sex and (2) the evidence was sufficient to support convictions for murder and rape.

Issues

Issue Plaintiff's Argument (State) Defendant's Argument (Carver) Held
Whether the trial court erred under the corpus delicti rule by playing Carver's unredacted interview (portions discussing sex) Coroner and medical testimony, witness observations, and DNA constitute "some evidence" independent of the confession that a sexual offense occurred / that Camp was substantially impaired Testimony of pain and later impairment does not show "substantial impairment" at the time of sex; consensual sex while in pain is possible — admission violated corpus delicti Overruled: court found independent evidence (autopsy, injuries, witnesses, DNA) sufficient to admit the statements about sex under the low "some evidence" corpus delicti standard
Whether evidence was legally sufficient to support murder (purposeful killing) and rape (substantial impairment/inability to consent) Evidence supports purpose: acquisition/use of gun, jealousy/arguments, inconsistent statements, jail calls admitting safety was off; evidence supports rape: severe injuries, internal bleeding, witnesses describing incapacitation, and DNA on nipples Shooting was reckless (not purposeful); sex was consensual and insufficient proof of substantial impairment to negate consent Overruled: viewing evidence in the light most favorable to prosecution, a rational jury could infer Carver acted purposely in causing death and that Camp was substantially impaired and unable to consent; convictions affirmed
