Background

  • In Feb 2003 Warwick PD investigated a robbery; victim Degroat and three witnesses (Storms, Dailey, Boone) provided statements and Degroat identified Simpson in a 6-photo lineup. Detective Maslanka prepared complaints and the Warwick Village Court issued an arrest warrant for petit larceny and third-degree robbery.
  • Sisco participated in early interviews but did not further investigate after Maslanka sought the warrant; Maslanka later retired.
  • On Jan 7, 2012 Kingston police encountered Simpson, discovered an outstanding Warwick warrant, searched him (finding marijuana), arrested him, and transported him to Warwick; Warwick officers transferred him to Orange County jail where he received some medical accommodations.
  • Charges were dismissed March 30, 2013 because prosecution could not proceed within the applicable speedy-trial/limitations framework.
  • Simpson, pro se, sued Warwick PD, Det. Maslanka, and Det. Sisco under 42 U.S.C. § 1983 for unlawful search, false arrest/false imprisonment, malicious prosecution, and deliberate indifference to medical needs; defendants moved for summary judgment.
  • The District Court treated Warwick PD claims as against the Town of Warwick, denied late joinder of Kingston Officer Feragola, and granted summary judgment to all defendants on all claims.

Issues

Issue Plaintiff's Argument Defendant's Argument Held
Unlawful search (4th Am.) Search by Kingston officers lacked probable cause; Warwick defendants liable Warwick officers did not participate in or direct Kingston search; no personal involvement Dismissed — Warwick defendants not personally involved; no municipal liability absent underlying violation
False arrest / false imprisonment Warrant was invalid (witness statements false) and execution in 2012 was wrongful (statute of limitations/speedy-trial bar) Warrant was supported by probable cause in 2003 based on victim/witness statements; officers could not be expected in 2003 to predict later procedural bar; execution of a facially valid warrant does not make arrest unlawful Dismissed — probable cause existed when warrant issued; no personal or Monell liability
Malicious prosecution Prosecution was malicious because charges were time-barred and should not have been pursued/arrest executed Malicious prosecution requires lack of probable cause and actual malice; probable cause existed in 2003 and there is no evidence of malice or knowledge of time-bar defense Dismissed — no lack of probable cause or proof of actual malice; claim not properly pleaded in any event
Deliberate indifference to medical needs (Fourteenth/Eighth) Warwick officers ignored severe leg pain and delayed/denied needed care while detained Plaintiff received a wheelchair, placement in medical unit at jail, and later hospital care; delay was short and injury was not shown to be a serious medical condition; no officer had actual knowledge of substantial risk Dismissed — objective and subjective elements not met; no personal or municipal liability
