Background

  • Georgetown of the Highlands Condominium Owners’ Association sued unit owner Stella Nsong in foreclosure for unpaid assessments and sought enforcement of its lien; the complaint alleged she owed roughly $7,417–$7,489.72 plus interest and costs.
  • Service issues delayed proceedings; Nsong initially responded pro se, later obtained counsel, and filed counterclaims after the association moved for summary judgment on the foreclosure claim.
  • The association moved for summary judgment on its complaint (July 11, 2016) and later on Nsong’s counterclaims (March 10, 2017); Nsong did not file opposing evidentiary material or a dispositive motion in her favor despite being given time to do so.
  • Counterclaims alleged trespass, negligence, discharge of lien, invasion of privacy/intrusion, and breach of contract based on the association’s entry into her unit to repair shared sewage piping and removal of contaminated carpeting during an emergency.
  • The magistrate granted summary judgment to the association on both the foreclosure complaint and all counterclaims; the trial court adopted the magistrate’s decision, awarded unpaid assessments and attorney fees to the association, and entered judgment recognizing the United States’ tax liens. Nsong appealed and raised ten assignments of error.

Issues

Issue Plaintiff's Argument (Association) Defendant's Argument (Nsong) Held
1) Summary judgment on association’s foreclosure complaint Records (billing statement, affidavit) show unpaid assessments and continuing lien; no opposition was filed Contest amount and existence of genuine factual disputes Court granted summary judgment to association; amount owed supported by billing records and unopposed evidence.
2) Trial court’s order to file dispositive motion within set time Deadline was reasonable case-management; extension was granted Court abused discretion by "ordering" her to move when Civ.R. 56 uses "may"; lack of discovery No abuse of discretion; court merely set a deadline and later extended it; Nsong failed to move within time.
3) Summary judgment on trespass counterclaim Association’s declaration/bylaws grant maintenance easement and emergency-entry authority Entry was unlawful and destructive Entry was authorized under maintenance easement/emergency exception; trespass claim failed.
4) Summary judgment on negligence counterclaim Association acted reasonably to stop leak, mitigate damage, and repair shared piping; owner had maintenance duty Association breached duty in manner of entry/repairs causing damage No evidence of breach; association acted under emergency authority and to mitigate greater harm.
5) Discharge of lien under R.C. 5311.18(C) Billing records and lien support amount due; no evidence contesting charges Lien improperly charged; insufficient proof supporting liens No genuine issue: plaintiff’s records established obligation; claim to discharge lien failed.
6) Invasion of privacy/intrusion claim Entry was permitted by bylaws in emergencies; no public disclosure occurred Entry was offensive and an intrusion on seclusion No public disclosure or false-light allegation; claim fails.
7) Breach of contract counterclaim Bylaws/declaration authorized entry and allocated maintenance duties to owner Association breached contractual duties to owner No specified contract or factual dispute shown; court granted summary judgment for association.
8) Attorney fees awarded to association Declaration allows recovery of fees in foreclosure; submitted expert testimony supporting reasonableness of hours/rates Declaration not admitted at hearing; objected to expert qualification Award affirmed: declaration was in the record; trial court properly qualified and relied on expert testimony; fees reasonable.
9) Judgment in favor of United States (tax liens) Government recorded notices of federal tax liens and filed an answer asserting interest USA did not actively litigate or produce evidentiary material at trial Court recognized recorded tax liens; judgment for USA affirmed because appellant produced no evidence to rebut.
