In a comm nobis proceeding, defendant appeals from an order of the County Court, Kings County, dated September 15, 1959, which denied, without a hearing, Ms application to vacate a judgment of said court, rendered October 16, 1957 after trial, convicting him of robbery in the first degree, and imposing sentence.
