In an action to recover damages for injuries to person and property, arising out of the collision of two motor vehicles at a street intersection, plaintiff appeals from an order of the Supreme Court, Kings County, dated January 18, 1960, denying his motion for summary judgment, pursuant to rule 113 of the Rules of Civil Practice.
