Motion to dismiss appeal or, in the alternative, to vacate the *831September 7, 1990 order granting defendant permission to appeal, granted to the extent that the September 7, 1990 order is vacated, the People are directed to serve and file papers in opposition to defendant’s criminal leave application by January 22, 1991, and the criminal leave application is to be considered de novo.
