MEMORANDUM OF DECISION
The objection to the report of the attorney referee is sustained. There is no allegation of bad faith nor a finding of bad faith which are necessary for the plaintiff to prevail. See Barrett Builders v. Miller, 215Conn.316 (1990).
Judgment shall enter on both counts for the defendant.
