This letter is being issued in response to your request for certification, pursuant to A.C.A. §
AN ACT TO IMPOSE A MINIMUM TERM OF IMPRISONMENT BEFORE CERTAIN OFFENDERS ARE ELIGIBLE FOR PAROLE
A PROPOSED ACT REQUIRING ANY PERSON WHO IS FOUND GUILTY OR PLEADS GUILTY OR NOLO CONTENDERE OR MURDER, KIDNAPPING, RAPE, CAUSING A CATASTROPHE, OR ANY FELONY INVOLVING THE USE OF A DEADLY WEAPON SHALL NOT BE ELIGIBLE FOR PAROLE UNTIL THE PERSON SERVES EIGHTY-FIVE (85%) OF THE TERM OF IMPRISONMENT TO WHICH THE PERSON IS SENTENCED. NOR SHALL THEY BE ELIGIBLE FOR ANY WORK RELEASE OR 309 WORK PROGRAMS. THIS ACT SHALL BECOME EFFECTIVE ON THE DATE OF APPROVAL AND BE APPLICABLE TO ALL FUTURE SENTENCING UNDER THESE GUIDELINES. ALL PROVISIONS OF THIS ACT OF A GENERAL AND PERMANENT NATURE ARE AMENDATORY TO THE ARKANSAS CODE OF 1987 ANNOTATED AND THE ARKANSAS CODE REVISION COMMISSION SHALL INCORPORATE THE SAME IN THE CODE. IF ANY PROVISION OF THIS ACT OR THE APPLICATION THEREOF TO ANY PERSON OR CIRCUMSTANCE IS HELD INVALID, SUCH INVALIDITY SHALL NOT AFFECT OTHER PROVISIONS OR APPLICATIONS OF THE ACT WHICH CAN BE GIVEN EFFECT WITHOUT THE INVALID PROVISION OR APPLICATION, AND TO THIS END THE PROVISIONS OF THIS ACT ARE DECLARED TO BE SEVERABLE. ALL LAWS AND PARTS OF LAWS IN CONFLICT WITH THIS ACT ARE HEREBY REPEALED.

Because the above-stated guidelines for the approval of popular names and ballot titles require that I analyze their sufficiency in light of the substance of the actual proposal, I am unable either to approve or to reject your proposed popular name and ballot title.
