Wyoming Emergency Planning Districts Rules
Section 1. Authority. These rules are written in accordance with the authority provided in Wyo. Stat. § 35-9-153(f) and pursuant to the requirements of the Wyoming Administrative Procedure Act, Wyo. Stat. § 16-3-101 et seq.
Section 2. Emergency Planning Districts established. The State Emergency Response Commission (SERC) hereby establishes twenty-three (23) local emergency planning districts in Wyoming.
(a) The jurisdictions of the local emergency planning districts shall correspond to the jurisdictions of the twenty-three (23) counties in the state.
(b) Each local district shall be named after its corresponding county (e.g. Albany County Emergency Planning District).
Section 3. Appointment of Local Emergency Planning Committees; membership; support.
(a) The SERC shall appoint members of the Local Emergency Planning committees (LEPCs) for each local emergency planning district.
(i) The SERC shall annually review the membership and activities of each LEPC.
(ii) The SERC shall annually report to the Governor on the activities of each LEPC.
(b) The membership of each LEPC shall include, at a minimum, representatives from each of the following groups or organizations:
(i) Elected state, tribal and local officials
(ii) Law enforcement, homeland security, firefighting, emergency medical services, health, local environmental, hospital and transportation personnel;
(iii) Broadcast and print media;
(iv) Community groups; and
(v) Owners and operators of facilities subject to the requirements of 42 U.S.C. § 11001 et seq., or if not applicable, an industrial-related representative.
(c) The SERC shall make every reasonable effort to ensure each LEPC is actively supported by each political subdivision in its jurisdiction.
(a) These rules are effective when all required approvals have been granted as required by Wyo. Stat. § 16-3-101 through 16-3-115.
