"Customer-owner" means the owner of a residential-scale or commercial-scale renewable energy system, where such owner:

1. (1) Is not a utility;
2. (2) Is the primary account holder of the utility account; and
3. (3) Either owns or occupies the premises where the renewable energy system is installed.
