1. (1) Department authority to petition. The department may petition for the rescission of permits issued by local government pursuant to RCW 90.58.140(8).

2. (2) Form of the petition. A petition for rescission shall comply with the following requirements:

   1. (a) The petition shall contain a copy of the written notice provided to the local government and the permittee involved;
   2. (b) The petition shall be filed with the board within fifteen days of the termination of the thirty-day notice to local government and the permittee as provided by RCW 90.58.140(8).
   3. (c) At the time of filing the petition with the board, the department shall give written notice of such petition to the local government and the permittee involved.
