1. (1) Mediation is a process in which a trained mediator conducts a meeting with you and DVR representative, usually your DVR counselor, to help you settle a disagreement.

   1. (a) The mediator does not work for DVR.
   2. (b) The mediator does not make decisions about your case.
   3. (c) Mediation is voluntary for all parties.

2. (2) During mediation:

   1. (a) Each party presents information or evidence;
   2. (b) The mediator reviews and explains the laws that apply; and
   3. (c) The mediator helps you and the DVR representative reach an agreement, if possible.
3. (3) You may ask someone to represent you during the mediation, including a CAP representative, however, you must be present.
4. (4) Agreements you and DVR reach through mediation are not legally binding.
