The following limits apply to providers of waiver services:

1. (1) Your spouse must not be your paid provider for any waiver service.
2. (2) If you are under age 18, your natural, step, adoptive parent, legal representative, or DCYF out-of-home caregiver must not be your paid provider for any waiver service.

3. (3) If you are age 18 or older, your natural, step, or adoptive parent must not be your paid provider for any waiver service with the exception of:

   1. (a) Transportation per WAC 388-845-2200 through 388-845-2210;
   2. (b) Residential habilitation services per WAC 388-845-1510 if your parent is certified as a residential agency per chapter 388-101 WAC; or
   3. (c) Respite care if you and the parent who provides the respite care live in separate homes.

4. (4) If you receive CIIBS waiver services, your legal representative or family member per WAC 388-845-0001 must not be your paid provider for any waiver service with the exception of:

   1. (a) Transportation per WAC 388-845-2200 through 388-845-2210; and
   2. (b) Respite per WAC 388-845-1605 through 388-845-1620.

5. (5) A person must not be your provider of a DDA waiver service if the person is also:

   1. (a) Providing a DCYF-paid or tribal-paid service to you; or
   2. (b) Is your DCYF or tribal out-of-home caregiver.
