DDA will assign you to the waiver with the minimum service package necessary to meet your health and welfare needs, based on its evaluation of your DDA assessment as described in chapter 388-828 WAC and the following criteria:

1. (1) For the individual and family services waiver, you:

   1. (a) Live at home with family; and
   2. (b) Are assessed to need a waiver service to remain at home with family.
2. (2) For the basic plus waiver your health and welfare needs require a waiver service to remain in the community.

3. (3) For the core waiver:

   1. (a) You are at immediate risk of out-of-home placement due to your disability and not related to chapter 13.34 RCW; or
   2. (b) You have an identified health and welfare need for residential services that cannot be met by the basic plus waiver.
4. (4) For the community protection waiver, refer to WAC 388-845-0105 and chapter 388-831 WAC.

5. (5) For the children's intensive in-home-behavioral support waiver, you:

   1. (a) Are age eight or older but under age 18;
   2. (b) Live at home with family;
   3. (c) Are assessed at high or severe risk of out-of-home placement due to challenging behavior per chapter 388-828 WAC; and

   4. (d) Have a signed family participation agreement from your:

      1. (i) Parent, guardian, and primary caregiver if other than your parent or guardian; and
      2. (ii) Legal representative if that person is not your parent or guardian and you are subject to a state or tribal court dependency action.
