1. (1) If DSHS finds that the estate of a resident is able to pay all or a portion of their monthly costs for care, support, and treatment, they must serve a written notice of finding of responsibility (NFR) on the:

   1. (a) Guardian of the resident's estate; or
   2. (b) If a guardian has not been appointed, resident's spouse or parent or other person acting in a representative capacity and in possession of the resident's property; and
   3. (c) The superintendent of the state school.
2. (2) If a resident is an adult and is not under a legal disability, the department must personally serve the NFR on the resident.
