1. (1) Agency providers are required to complete and pass a name and date of birth background check prior to working with a client.

2. (2) Agency provider workers are required to complete and pass a name and date of birth background check:

   1. (a) Every two years; and
   2. (b) Any time the home care agency employer requests a new check.

3. (3) In addition to the name and date of birth background check, agency providers are required to complete and pass a fingerprint-based background check:

   1. (a) If hired after January 7, 2012, and in accordance with provisional hire rules in WAC 388-113-0109;
   2. (b) If they have lived out of state since the last fingerprint-based background check was completed; or
   3. (c) Any time the home care agency requests a new check.
