The enhanced services facility must only admit or continue to provide services to a resident when:

1. (1) The department has determined that the individual is eligible for placement in an enhanced services facility.

2. (2) The facility can safely and appropriately meet the assessed needs and preferences of the resident:

   1. (a) With available staff; and
   2. (b) Through reasonable accommodation.

3. (3) Admitting the resident does not negatively affect the ability of the facility to:

   1. (a) Meet the needs, and does not endanger the safety, of other residents and members of the community; or
   2. (b) Safely evacuate all people in the facility during an emergency according to the approved fire safety and evacuation plans appropriate to the occupancy type of the building.
