Wash. Admin. Code § 388-02-0455 – Who may be a witness?

(1) A witness may be:
1. (a) You or the DSHS representative; or
2. (b) Anyone you, the ALJ, or the DSHS representative asks to be a witness, including DSHS employees.
(2) The ALJ decides who may testify as a witness.
(3) Unless DSHS agrees, a former DSHS employee may not be an expert witness against DSHS if that employee was actively involved in the case while working for DSHS.
