Wash. Admin. Code § 296-360-170
An employee who refuses to comply with industrial safety and health standards or valid safety rules implemented by the employer in furtherance of WISHA is not exercising a right afforded by WISHA. Discipline taken by employers solely in response to an employee's refusal to comply with appropriate safety rules and regulations is not retaliation prohibited by RCW 49.17.160. This situation should be distinguished from refusals to work discussed in WAC 296-360-150.
