A title insurance agent must not, without the written consent of the commissioner, employ any person that has been convicted of, or plead no contest to either:

1. (1) A felony involving dishonesty or a breach of trust within the last ten years; or
2. (2) A gross misdemeanor involving theft, fraud, forgery, embezzlement or the mishandling of funds, within the last year.
