In computing any period of time prescribed by this rule, the commissioner:

1. (1) Will not count the first day;
2. (2) Will count the last day, unless the last day is a weekend or a state legal holiday; and
3. (3) Will count the next day that is not a weekend or a state legal holiday as the last day if the last day is a weekend or a state legal holiday.
