1. (1) A license issued by the department is required before operating or advertising a transient accommodation. A license is effective for one year from date of issuance.

2. (2) For initial licensure, an applicant shall submit a complete application packet to the department at least 60 days before commencing business that includes the following:

   1. (a) A completed application on a form provided by the department;
   2. (b) A completed self-inspection on a form provided by the department;
   3. (c) The fee specified in WAC 246-360-990;
   4. (d) Verification of uniform business identifier; and
   5. (e) Other information as required by the department.

3. (3) For license renewal, a licensee shall submit a renewal packet annually on or before the expiration date of the current license that includes the following:

   1. (a) A completed renewal form provided by the department;
   2. (b) A completed self-inspection on a form provided by the department;
   3. (c) The fee specified in WAC 246-360-990; and
   4. (d) Other information as required by the department.
4. (4) A complete renewal packet may be submitted by mail postmarked no later than midnight on the license expiration date, or by submitting to the department personally or electronically no later than 5:00 p.m. on the expiration date.
5. (5) If the licensee fails to submit a complete renewal packet outlined in subsections (3) and (4) of this section by the license expiration date, the license becomes invalid and the transient accommodation is no longer authorized to operate.

6. (6) Within 35 days from the license expiration date, an invalid license may be reinstated upon reapplication for a license after the licensee:

   1. (a) Submits a complete renewal packet to the department as outlined in subsection (3) of this section; and
   2. (b) Pays the applicable late fee as specified in WAC 246-360-990.

7. (7) After 35 days from the license expiration date, an invalid license may be reinstated upon reapplication for a license if the licensee:

   1. (a) Passes an on-site survey prior to the department reinstating an invalid license; and
   2. (b) Pays the applicable late fee as specified in WAC 246-360-990.

8. (8) At least 15 days prior to a transfer of ownership, a change in the uniform business identifier number of a transient accommodation, or closure of a business, the current licensee shall notify the department and submit the following:

   1. (a) The full name and address of the current licensee and prospective licensee;
   2. (b) The name and address of the currently licensed transient accommodation, and the name under which the transferred transient accommodation will operate;
   3. (c) The date of the proposed change; or
   4. (d) Other information as required by the department.

9. (9) At least 15 days prior to a transfer of ownership or a change in the uniform business identifier number of a transient accommodation, the prospective new licensee shall apply for licensure by submitting:

   1. (a) A completed application on a form provided by the department;
   2. (b) A completed self-inspection on a form provided by the department;
   3. (c) The fee specified in WAC 246-360-990;
   4. (d) Verification of a uniform business identifier; and
   5. (e) Other information as required by the department.

10. (10) A licensee shall notify the department when increasing the number of lodging units by submitting:

    1. (a) A completed application on a form provided by the department;
    2. (b) The fees specified in WAC 246-360-990 for an amended license; and
    3. (c) Other information as required by the department.

11. (11) The licensee shall notify the department when:

    1. (a) Changing the name of the transient accommodation; or
    2. (b) Conducting any facility updates related to the license.

12. (12) The licensee shall notify the department prior to construction as defined in WAC 246-360-010(7) by submitting:

    1. (a) A description of the construction;
    2. (b) A description of how the construction will be used;
    3. (c) A description of any changes in the functional use of existing construction;
    4. (d) Documentation of approvals issued by local authorities having jurisdiction; and
    5. (e) Other information as required by the department.
