(1) Department of health authority. The department has authority to enter any building or area used for TWH, at reasonable times to:
- (a) Inspect the site for compliance with this chapter and related standards; and
- (b) Determine, based on reasonable cause, if a building or condition on the premises is unsafe, dangerous or hazardous.
- (2) Refusal of entry. When the operator refuses entry or has required a warrant, the department of health will seek remedies provided by law to secure entry to the TWH site.
- (3) Occupied TWH. The department of health must present credentials to the occupant and request the right to enter a dwelling unit when occupants are in residence.
- (4) Unoccupied TWH. When a dwelling unit does not have occupants in residence, the department of health must make a reasonable effort to locate the operator of the TWH to request entry.
